Manufacturer vs. producer: key differences under the PPWR

We are publishing the third episode of “Entendiendo el PPWR”, our video series explaining the main developments introduced by the European Packaging and Packaging Waste Regulation in a clear and accessible way.

In this new episode, we look at the difference between a manufacturer and an EPR producer, two roles distinguished by the PPWR and subject to different legal obligations.

The manufacturer is the party that designs, manufactures or has packaging manufactured under its own name or trademark and must draw up the EU Declaration of Conformity.

The EPR producer, on the other hand, is generally the party that places packaging or packaged products on the national market for the first time and must comply with obligations such as registration with MITECO, annual reporting of packaging placed on the market and financing its management through a PRO.

Correctly identifying each role is essential to comply with the obligations established by the regulation.
