I am a producer
As manufacturers of packaging, you are responsible for managing and funding the recycling of these products, from collection, transport and processing to proper waste management.
Royal Decree 1055/2022 brought in significant changes in packaging regulations, expanding Extended Producer Responsibility (EPR) to include commercial and industrial packaging, getting rid of the previous distinctions based on the source of the packaging. As a result, all packaging is now subject to the same rules.
Plus, the regulation imposes new financial obligations for producers, related to collecting packaging from general waste and cleaning roads, beaches and recreational areas, which were previously excluded from EPR.
All producers whose companies are not based in Spain need an authorized representative (as required by the Agència de Residus de Catalunya) to register on the Producers Registry (RPPP).
+ Extended Producer Responsibility (EPR): Means packaging producers are responsible for how their products are managed once they become waste. This means they must fund and manage selective collection, recycling and processing systems.
+ Registration and regulatory compliance: Producers are obliged to register with the Registry of Product Producers – Packaging (REPPRE) and comply with the provisions of current regulations on managing packaging waste.
+ Labelling and consumer information: Producers must ensure that the packaging they put onto the market complies with the labelling requirements laid out in Spanish law, including information on the material the packaging is made of, recycling instructions and other significant data.
+ Promoting the circular economy: They are responsible for promoting commercial practices and packaging that encourage the circular economy and help reduce the environmental impact of packaging.
In addition to the serious environmental damage that can result from improper management of packaging, if producers fail to comply with the provisions of Law 1055/2022 on Packaging and waste they can be subject to penalties in the form of fines or other sanctions, such as temporary occupational disqualification or closure of their facilities.
These sanctions are accompanied by final penalties ranging from €2,001 to €100,000.
